Doing nothing may interfere with employee’s rights

(Dec. 2, 2011) -- Recently, the United States District Court in Indianapolis was asked to review a situation involving an employee who was terminated after she had taken more than 12 weeks of family leave. The court found that the hospital may have actually interfered in the employee's FMLA rights by doing nothing to alert her that her job may be in jeopardy.
